Terms of Use for SQLite Viewer PRO

1. Acceptance of Terms
By installing or using the SQLite Viewer PRO for Visual Studio Code (VS Code) extension ("Extension"), you agree to comply with and be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not install or use the Extension.
2. License to Use the Extension
Upon purchasing a valid license for SQLite Viewer PRO, the publisher grants you a non-exclusive, worldwide, royalty-free license to use the PRO version of the Extension for any purpose, including commercial applications, subject to the terms and conditions set forth herein.
3. Restrictions
- No Modification or Reverse Engineering: You may not modify, reverse engineer, decompile, or disassemble the Extension, in whole or in part.
- No Redistribution: You may not redistribute the Extension, including premium features, in any form.
- No Derivative Works: You may not create derivative works based on the Extension.
- No Transfer of Rights: You may not rent, lease, lend, sell, sublicense, assign, or transfer your rights in the Extension to any third party.
- No Use in High-Risk Activities: The Extension is not designed for use in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, where failure could lead directly to death, personal injury, or severe physical or environmental damage.
- Compliance with Laws: You must comply with all applicable laws and regulations in your use of the Extension.
- User Responsibility: You are responsible for maintaining the confidentiality of any non-public information about your systems and for any activities or actions performed using the Extension.
- Third-Party Services: If the Extension enables access to third-party services, you agree to use such services at your sole risk and subject to the terms and conditions of the respective third parties.
4. Device Limitations and Usage Conditions
- Device Limitations: You are permitted to install and use the PRO version of the Extension on up to two (2) devices simultaneously.
- Offline Usage: The PRO version of the Extension may be used offline for a maximum period of fourteen (14) consecutive days. After this period, the Extension must connect to the internet to verify the license.
- License Activation: A valid activation key is required for unlocking and using the PRO version. The activation key is tied to your account and device usage.
- License Transfer: You may transfer your license to different devices, provided that you deauthorize any previously authorized devices. Such transfers may be subject to a maximum number of authorized device changes within a certain time period.
5. Intellectual Property Rights
The Extension's source code is proprietary and owned by the publisher. You are not granted any rights to the source code. All rights are reserved by the publisher. The Extension may include components that are licensed separately and are the property of their respective copyright holders. These components are used in compliance with their respective open-source licenses. Detailed information on specific licenses and attributions is provided in the Appendix: Third-Party Licenses.
6. Trademarks
The term "SQLite" is a trademark of Hipp, Wyrick & Company, Inc. The use of "SQLite" in the name of this Extension is in accordance with the SQLite trademark usage guidelines. This Extension is an independent product and has not been authorized, sponsored, or otherwise approved by Hipp, Wyrick & Company, Inc.
The term "Visual Studio Code" (VS Code) is a trademark of Microsoft Corporation. This Extension is an independent product and has not been authorized, sponsored, or otherwise approved by Microsoft Corporation.
7. Payment and Fees
- Pricing: The PRO version of the Extension is provided on a paid basis. Pricing details are outlined on the publisher’s website or sales platform. All fees are payable in the currency specified during the purchase process.
- Refund Policy: Refunds are subject to the publisher's refund policy, as specified at the time of purchase. Refunds will not be provided for the inability to use the Extension due to a violation of these Terms.
8. No Warranty
The Extension is provided "as is," without warranty of any kind. The publisher expressly disclaims all warranties, whether express, implied, or statutory, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
In no event shall the publisher be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from the use of or inability to use the Extension, including its PRO features.
10. Indemnification
You agree to indemnify and hold harmless the publisher from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Extension or violation of these Terms.
11. Maintenance and Support
The publisher is under no obligation to provide maintenance or support for the Extension. However, the publisher may, at their sole discretion, choose to provide such maintenance or support on a case-by-case basis. Providing maintenance or support at any time does not create any obligation to provide further maintenance or support in the future.
12. Privacy and Data Collection
The Extension may collect telemetry data to help improve the performance and user experience. This data may include, but is not limited to, information about your device, usage patterns, and error reports. The publisher may share this telemetry data with third parties to assist in improving the Extension and user experience. The publisher will not collect any personally identifiable information (PII). By using the Extension, you agree to the collection and use of telemetry data as described.
13. Changes to Terms
The publisher reserves the right to modify these Terms at any time. Your continued use of the Extension following any such modification constitutes your acceptance of the modified Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Singapore, without regard to its conflict of law principles.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
